Virtual Tutoring Enrollment
Agreement & Guidelines
Note: Clear Prep Learning Inc. is a provider of tutoring services to Vivvi
It is agreed that:
I hereby request to enroll my child in the VIrtual Tutoring program provided by Clear Prep Learning Inc.
I understand that by agreeing to this, I am obligated to the terms of this contract.
Scheduling tutoring sessions. I will work directly with the Tutor to establish a regular weekly set schedule of tutoring sessions for the Student(s). While my tutor may accommodate short-term schedule change requests, they are under no obligation to do so. If my tutor is unable to accommodate a permanent schedule change request, I will notify the tutoring coordinator with my new scheduling needs.
Cancellations of tutoring sessions. I understand that the tutor has allocated their time to my student for the agreed on time. As a result, I will make every attempt to cancel sessions at least 24 hours in advance by contacting the Tutor and sending an email to the Tutoring Coordinator. Cancellations made less than an hour in advance or after a session starts will incur a full session charge.
Educational expertise. Clear Prep Learning Inc. will attempt to match the Student(s) with an appropriate Tutor based on content knowledge, experience, availability, and my requests. Tutors are primarily engaged to assist with learning across domains, and will work to accommodate needs as appropriate for children currently enrolled in Grades K-12. If the assigned coach is unable to provide the needed support, Clear Prep Learning Inc. will endeavor to match the Student(s) with a replacement Tutor.
Tutor expectations & cancellations. Since Clear Prep Learning Inc. holds the highest standards for its Tutors, I will contact the Clear Prep Learning Inc. team if I feel my Tutor is not meeting these standards. Clear Prep Learning Inc.’s Tutors may from time to time need to cancel or reschedule a session. If I feel my Tutor is canceling or rescheduling too frequently, I will contact Clear Prep Learning Inc.’s Virtual Tutoring Director at alan@clearprep.net to discuss this.
Tutors & Competitive Agreements: All tutors working with Clear Prep Learning Inc. Virtual Tutoring are bound by competitive agreements which disallow them from being able to work with families outside of the Clear Prep Learning Inc. Virtual Tutoring program. This includes siblings, other family members, and former students. Clear Prep Learning Inc. offers families the choice of a direct to consumer option in case they are no longer going to be employed with one of our partner organizations. This direct to consumer option may also be implemented in the case whereby a family no longer has credits to be utilized for Clear Prep Learning Inc. Virtual Tutoring. Tutors MAY NOT tutor families they began tutoring through a Clear Prep Learning Inc. program outside of that program--during, or at a later date.
Planned session lengths. Weekly sessions are scheduled for one hour. This allows 55 minutes for direct tutor/student interaction and 5 minutes for the Tutor to submit a session report. I will reach out to the Virtual Tutoring Director for this program at alan@clearprep.net if the Student(s) has learning needs that may require additional sessions.
Drop-in/On-demand tutoring. Drop-in (on-demand) tutoring is also available for any family enrolled in a Clear Prep Learning Inc. Virtual Tutoring Program. Drop-in tutoring runs Monday-Thursdays 6-8pm EST (not including holidays and pre-announced breaks). Tutors will be standing by to offer students quick help in the moment, with sessions not to exceed 20 minutes. This is on a first come first serve basis and I understand that the Student(s) may need to wait in queue while the available Tutors finish working with other students.
Requests for Tutor change. I will email the Tutoring Director at alan@clearprep.net if I feel the tutoring match is not benefiting the Student(s) or to request a different coach. Any request is granted or not granted at Clear Prep Learning Inc.’s sole discretion.
Balance between schoolwork & enrichment work. It is important that tutors and students work together to maintain an appropriate balance between schoolwork and enrichment work. If a student does not have school work to be completed, tutors will have access to tools and materials to have enriching sessions on various topics provided by parents on intake surveys. In addition, tutors may use memory, visual spatial, logical reasoning, and other “brain games” to provide a fun and enriching experience for students.
Tips for having a productive online tutoring session. In order to enable the Student to get the most out of each session, I will
Have the student work in a quiet place.
Make sure the student is using headphones, when possible.
Make sure that the most recent version of Zoom is downloaded on the Student’s device and the Student is logged in 1-2 minutes prior to the session start
If wi-fi speed is a factor, make sure the Student sits in a good location and that the rest of the household members try to not use too much bandwidth during session time.
Make sure the student is sitting upright at a table or a desk. NO LYING DOWN.
Make sure the student has paper, pens/pencils, and relevant materials nearby at the beginning of the session.
Student behavior during sessions. Clear Prep Learning Inc. maintains right and sole discretion to dismiss a student from the program for using inappropriate language, verbally abusing a Tutor, showing images or websites non-related to direct tutoring topics, or any other instances of vulgarity, inappropriate attire, hand or body gestures, etc.
Contact between Tutors and Families/Students. Communication between Tutors and myself or other parents/guardians may occur via text message, email, Tutorbird interface, or phone calls. Clear Prep Learning Inc. does not allow Tutors to text message with students directly, regardless of age, unless there is a technical issue. Tutoring should always take place on Zoom.us. In a special circumstance, a Coach and student may use Facetime as a backup, but Clear Prep Learning Inc. requires its Coaches to report this as an exception case.
Third party tools. Clear Prep Learning Inc. utilizes several computer software applications and web-based services, owned and/or operated not by Clear Prep Learning Inc. but by third parties. These include Apple applications and other educational web-based programs that may be added throughout the calendar year. Under federal law, in order to provide students with the most effective web-based tools and applications for learning, Clear Prep Learning Inc. must obtain parental consent before collecting personal information from students under the age of 13. Please be advised that without your agreement below, Clear Prep Learning Inc. will be unable to provide the Student(s) with the resources, teaching and curriculum offered by our MacBook/iPad program (only applicable to students in the Four’s program).
Pause or change in enrollment. Once I sign this contract, I must email the tutoring coordinator if I need to change the enrollment status of the Student(s) or wish to conclude tutoring sessions for my child/children. Any pauses or changes in enrollment for virtual tutoring must be done fifteen days prior to a students' final session with their tutor. To pause or change your enrollment please complete this CHANGE IN ENROLLMENT FORM.
Maintaining enrollment. If at any time in the opinion of Clear Prep Learning Inc., the Student’s enrollment shall be deemed detrimental to his/her health or progress or to other students, he/she may be dismissed. Of equal importance, it is expected that I and all parents and guardians of the Student(s) abide by, and be supportive of, the policies and procedures of Clear Prep Learning Inc.. If, in the sole judgment of Clear Prep Learning Inc., actions by the Student’s parents or guardians undermine policies and procedures or disrupt the community, the Student’s enrollment may be terminated. In case of such dismissal, Clear Prep Learning Inc. will not refund any tuition, fees or other charges (if/when applicable).
Payments, Enrollment stipulations & Auto-Renewal. Payments for tutoring sessions are made monthly for the upcoming month. The Student’s enrollment in the Clear Prep Learning Inc. Virtual Tutoring Program is dependent upon keeping my account in good standing. Families can adjust their payment dates on the Tutorbird platform. Billing is renewed automatically unless parent/guardian notifies Clear Prep Learning Inc. Virtual with Tutoring in writing 15 days prior to the upcoming billing cycle that the child or children will be discontinuing tutoring services (alan@clearprep.net). Renewal amounts are based on previous pricing agreements.
Hiring Clear Prep Learning Inc. Tutors. By execution hereof, I agree that I will not solicit for employment, hire, or engage as an independent contractor, or permit any organization directly or indirectly controlled by me to solicit for employment, hire, or engage as an independent contractor, any person employed by Clear Prep Learning Inc. at any time during the later of the term of Clear Prep Learning Inc.’s provision of services to me and Clear Prep Learning Inc.’s provision of services to my employer. Any additional services desired by a Clear Prep Learning Inc. employee may be requested through the Virtual Tutoring Director: alan@clearprep.net
Employment Subsidy: Clear Prep Learning Inc. partners with employers whereby employers may subsidize in part or in whole tutoring services for child/children of employee(s). Should your relationship to the above listed employer change, you will:
If there is availability, be afforded the opportunity to maintain your enrollment at the Clear Prep Learning Inc. Tuition Rate.
If there is no availability, or if your employer has reclaimed your seat, be removed from the program.
Limited Liability. Clear Prep Learning Inc. MAKES NO WARRANTIES OR REPRESENTATIONS AS TO THE PERFORMANCE OR MERCHANTABILITY OF THE PRODUCTS OR SERVICES REFERRED TO IN, OR PROVIDED PURSUANT TO, THIS AGREEMENT. TO THE EXTENT PERMITTED BY APPLICABLE LAW, ALL IMPLIED WARRANTIES, INCLUDING THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT, ARE HEREBY EXCLUDED. IN NO EVENT SHALL Clear Prep Learning Inc. BE LIABLE FOR ANY DAMAGE TO HARDWARE OR SOFTWARE BY ANYONE ACCESSING Clear Prep Learning Inc.’S REMOTE SERVICES; NEITHER PARTY WILL HAVE ANY LIABILITY TO THE OTHER WITH RESPECT TO THE SERVICES OR ITS OBLIGATIONS UNDER THIS AGREEMENT OR OTHERWISE FOR SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, EVEN IF THAT PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL Clear Prep Learning Inc.’S LIABILITY FOR ANY REASON AND UPON ANY CAUSE OF ACTION WHATSOEVER WITH RESPECT TO ANY CLAIM MADE BY A CHILD OR FAMILY MEMBER THEREOF EXCEED THE AMOUNTS PAID TO Clear Prep Learning Inc. BY OR ON BEHALF OF SUCH CHILD.
